Setting up a LPA involves the following steps:
1. Choose Your Attorney(s) you may appoint one or multiple attorneys. They must be over 18 and someone you trust to act in your best interests.
2. Complete the LPA Forms, forms can be completed online at GOV.UK, by downloading paper forms(LP1F for financial affairs, LP1H for health and welfare). You must have mental capacity and must not be placed under pressure to sign the document. A certificate provider confirms this.
Before an LPA can be used, it must be registered with the office of the Public Guardian(OPG). Registration typically takes 8 to 10 weeks if completed correctly. The current fee to register each LPA is £92, with reductions/exemptions available. Cancelling or Changing an LPA if you still have mental capacity, you can cancel an LPA at anytime by sending a deed of revocation and the original document to the OPG. Changes of personal details(such as address) must be reported to OPG.
